Terms of Service

1. Acceptance of Terms

By accessing or using FivePulse ("the Service"), operated by FivePulse ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FivePulse is a cloud-based performance monitoring platform for FiveM game servers. The Service includes a FiveM server resource that collects performance telemetry, a web dashboard for viewing analytics, and related features such as alerts and script analysis.

3. Account Registration

To use the Service, you must create an account using Discord authentication or email registration. You are responsible for maintaining the security of your account credentials and API keys. You must not share your account with others or allow unauthorized access.

You must be at least 16 years of age to create an account and use the Service.

5. Subscriptions and Payments

FivePulse offers free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Price changes will apply to your next billing cycle after the notice period.

6. Data Collection

The FivePulse resource collects server performance metrics only. This includes per-resource CPU usage, entity counts, player counts (not player identities), hitch events, and server configuration values. We do not collect player IP addresses, chat messages, personal information, or any gameplay data. See our Privacy Policy for full details.

7. Data Retention

Telemetry data is retained according to your subscription plan:

Data older than your plan's retention period is automatically deleted. If you downgrade your plan, data beyond the new retention limit will be deleted.

8. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

9. Intellectual Property

The Service, including its design, code, features, and content, is owned by FivePulse and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. FivePulse is not responsible for any decisions you make based on data or recommendations provided by the Service. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding any claim.

11. Termination

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay for a paid subscription. You may delete your account at any time by contacting us.

12. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or dashboard notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
